TERMS OF SERVICE

1. Description of the Service
Fed-Up (“the App”) is an AI-powered entertainment application that generates fictional conversations, personalities, and exaggerated responses from the perspective of everyday objects. The App uses artificial intelligence to generate dialogue. Users interacting with the App are interacting with AI-generated content presented as fictional character voices.
All content generated by the App is:

• Fictional

• Satirical

• AI-generated

• Intended solely for entertainment purposes

The App does not provide professional, legal, medical, psychological, financial, or any other form of advice. Generated content may include profanity, mature language, and adult humor consistent with a 17+ entertainment classification.
The App is operated by Fed-Up Holdings LLC, an Oregon limited liability company.
2. Eligibility
The App is intended for users seventeen (17) years of age or older.
By using the App, you represent and warrant that:

• You are at least 17 years old

• You are legally capable of entering into binding agreements

• You have provided accurate information at account registration, including a truthful date of birth

The App employs self-attested age verification at account creation. By creating an account, you confirm under penalty of perjury that you are at least 17 years old and that the date of birth you provided is your true and accurate date of birth. Misrepresentation of age is grounds for immediate account termination without refund and may be reported to appropriate authorities. You acknowledge that Fed-Up Holdings LLC may use technical signals, behavioral indicators, or third-party verification tools to confirm age and to identify accounts believed to belong to users under 17.
The App is not intended for and may not be used by children under 17. We reserve the right to terminate any account at any time, without notice and without refund, if we have reason to believe the account holder is under 17.
3. PROHIBITED CONTENT AND CONDUCT — ABSOLUTE
This section is the binding standard for all content uploaded to, generated through, or otherwise transmitted within the App. Violations result in immediate content removal and may result in immediate, permanent account termination without refund.
3.1 Zero-Tolerance Categories (Immediate Permanent Account Termination)
The following are zero-tolerance violations. A single occurrence results in immediate permanent account termination, removal of all content, and reporting to law enforcement when required by law. No appeal is available for violations in this section.

• Child Sexual Abuse Material (CSAM) — any sexual, suggestive, or exploitative content depicting, simulating, generated to resemble, or implying any person under the age of 18, regardless of artistic, satirical, or fictional framing

• Any photograph or image of any person who appears to be under 18 uploaded for any purpose, whether or not the content is sexual in nature

• Content promoting or facilitating the sexual abuse of minors, including grooming language, instructional material, or content that normalizes such abuse

• Content depicting or threatening real-world violence against specific identifiable persons

• Content depicting terrorism, mass-casualty events, or terrorist propaganda

• Non-consensual intimate imagery of any person (“revenge porn”), real or AI-generated

3.2 Prohibited Content Categories
The following content categories are prohibited. Violations result in immediate content removal and may result in account suspension or termination depending on severity and history. Repeat violations of any single category result in permanent account termination.
You agree not to upload, generate, transmit, request the AI to produce, or attempt to elicit through the App any of the following:

• Nudity of any kind, partial or full, real or AI-generated, including but not limited to exposed genitalia, exposed female breasts, exposed buttocks, or any sexualized depiction of the human body, regardless of artistic, satirical, fictional, or educational framing

• Sexual content of any kind, including but not limited to depictions or descriptions of sexual acts, sexual arousal, sexual fluids, sexual touching, or sexual fantasy involving any identifiable person

• Pornographic content in any form, including written, visual, audio, or AI-generated material primarily intended to sexually arouse

• Photographs of real people uploaded without that person’s documented consent, regardless of whether the content is sexual in nature

• Sexual content involving real public figures, current or historical, including AI-generated content that simulates real public figures in sexual situations

• Sexual content involving any person identifiable from the user’s personal life, including but not limited to current or former partners, family members, coworkers, or acquaintances

• Deepfake content of real people, defined as AI-generated content designed to depict real persons in scenarios they did not consent to, whether sexual or otherwise. This prohibition includes content prohibited by applicable state and federal laws regulating synthetic media, in effect or hereafter enacted

• Content violating the right of publicity of any real person, defined as the unauthorized commercial or expressive use of a person’s name, likeness, voice, signature, or other personally identifying attributes

• Impersonation of real persons, including AI-generated dialogue attributed to or simulating real public figures or private individuals

• Hate speech, hate symbols, or content targeting protected groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, disability, or similar protected characteristics

• Content promoting, glorifying, or providing instruction in self-harm, suicide, or eating disorders

• Content depicting graphic violence, gore, severe injury, or animal cruelty

• Content promoting or providing instruction in illegal activities, including but not limited to drug manufacture or distribution, weapons construction, fraud, or unauthorized access to computer systems

• Content infringing copyright, trademark, or other intellectual property rights of third parties

• Content defamatory to real living persons or that invades the privacy of real living persons

• Malware, viruses, or harmful code

3.3 Prohibited Conduct
You agree not to:

• Attempt to bypass, circumvent, manipulate, or “jailbreak” the App’s content moderation systems or AI safety guardrails

• Use the App’s AI personas to generate content that the App’s safety systems are designed to prevent, including by prompting, indirect framing, or any other technique to elicit prohibited content

• Use the App for unlawful purposes

• Attempt to reverse engineer, decompile, or exploit the AI system or App infrastructure

• Interfere with the App’s functionality or security

• Use bots, scrapers, automated systems, or AI agents to access or operate the App

• Share, sell, transfer, or allow others to access your account

• Create multiple accounts to evade prior suspension or termination

• Use the App to harass, threaten, stalk, intimidate, or harm any person

3.4 Enforcement
We employ both automated and human content moderation. We reserve the right to:

• Remove or restrict any content that violates these Terms, without notice

• Suspend or terminate accounts that violate these Terms, without notice and without refund

• Retain user content, conversation records, and account information for the purpose of investigating violations, defending legal claims, complying with law enforcement requests, or as otherwise required by law, even after account termination or deletion

• Report violations to law enforcement and cooperate with law enforcement investigations

• Cooperate with court orders, subpoenas, and other lawful requests for information

3.5 Repeat Violations
Three or more violations of Section 3.2, or any single violation of Section 3.1, results in permanent account termination. Termination for violation of this Section 3 is without refund.
4. AI-Generated Content, Real-Person Disclaimer, and Risk Acknowledgment
The App generates fictional dialogue using artificial intelligence. AI personas in the App are fictional characters. Any resemblance to real persons, living or dead, is coincidental and not intended.
4.1 Notice of AI Interaction
You acknowledge and agree that you are interacting with artificial intelligence software. All character voices, dialogue, and generated content within the App are produced by AI. The App is not staffed by human operators communicating with you in real time. Where required by applicable law, AI-generated content is identified as such within the user interface. You agree not to remove, alter, or obscure any such identification.
4.2 AI Output May Be Incorrect or Fictional
You acknowledge and agree that:

• AI-generated responses may be exaggerated, satirical, absurd, mature, or otherwise consistent with the App’s 17+ comedy entertainment classification

• AI-generated content may contain inaccuracies, errors, nonsensical statements, or fictional statements presented in a confident manner

• AI personas may produce content that, while in character, contains factually incorrect statements about real persons, events, places, products, organizations, or circumstances

• Such statements are NOT intended as factual claims, are NOT verified by Fed-Up Holdings LLC, and should NOT be relied upon as accurate

• The App is not intended to and does not make verified factual statements about real individuals, events, or any other subject

4.3 The App Is Not Professional Advice
The App is entertainment software. The App does NOT provide:

• Medical, psychological, psychiatric, or mental health advice or treatment

• Legal advice or representation

• Financial, investment, tax, or accounting advice

• Career, relationship, educational, or other personal advice

• Crisis intervention or emergency assistance

• Substitute for professional consultation in any field

You should NOT make any medical, legal, financial, mental health, safety, or other significant decision based on AI-generated content within the App. If you need professional advice in any field, consult an appropriate licensed professional.
4.4 User Assumption of Risk
By using the App, you assume all risk associated with:

• Reading, listening to, or otherwise engaging with AI-generated content

• Any emotional, psychological, or behavioral reaction you may have to AI-generated content

• Any decision you make based on AI-generated content

• Any sharing, republication, or modification of AI-generated content outside the App

• Interactions with AI personas, including AI personas that may appear to express opinions, emotions, or judgments

You acknowledge that no AI safety system is perfect, that prohibited content may occasionally bypass the App’s moderation systems despite reasonable efforts, and that the App may occasionally produce content that some users find offensive, distressing, or inappropriate. You agree to use the reporting tools described in Section 9 if you encounter content you believe violates these Terms.
4.5 Content Safety Architecture
The App employs layered automated and human content-safety systems designed to prevent the generation of content that violates Section 3 of these Terms. As stated in Section 4.4, no safety system is perfect.
4.6 Republication Outside the App
You are solely responsible for any sharing, reposting, modification, or redistribution of AI-generated content outside the App. Fed-Up Holdings LLC is not responsible for, and disclaims all liability arising from, any republication by users of AI-generated content beyond the App, including but not limited to any republication that may identify, defame, violate the right of publicity of, or otherwise harm a third party.
5. Mental Health Notice and Crisis Resources
The App is mature humor entertainment software. It is NOT designed for, marketed to, or intended for use as a mental health support tool, crisis intervention service, suicide prevention resource, or substitute for professional mental health care.
5.1 If You Are in Crisis
If you are experiencing thoughts of self-harm, suicide, psychological crisis, or any other mental health emergency, the App is NOT a safe or appropriate resource. Please contact a qualified crisis service:

• 988 Suicide and Crisis Lifeline — call or text 988 (United States)

• Crisis Text Line — text HOME to 741741 (United States, Canada, United Kingdom, Ireland)

• International Association for Suicide Prevention — directory of crisis centers worldwide at https://www.iasp.info/resources/Crisis_Centres/

• If you are in immediate danger, call your local emergency services (911 in the United States, 999 in the United Kingdom, 112 in the European Union, or your country’s equivalent)

5.2 In-App Distress Detection
The App employs automated distress detection systems designed to identify language patterns potentially indicating self-harm, suicidal ideation, or psychological crisis. When such patterns are detected, the App is designed to interrupt the AI persona response and surface crisis resources, including the 988 Suicide and Crisis Lifeline contact information.
This safety system is intentionally calibrated to err on the side of over-detection. The App may interrupt AI persona responses based on language that does not, in fact, indicate crisis. This is a deliberate safety design choice. The App prioritizes user safety over conversational continuity.
The App’s distress detection does NOT replace professional crisis services. It is a referral mechanism, not a treatment mechanism. The App does not assess, treat, or provide care for any mental health condition.
5.3 User Acknowledgment
By using the App, you acknowledge and agree that:

• The App is NOT a mental health support tool, crisis intervention service, or substitute for professional care

• The App’s AI personas are NOT therapists, counselors, friends, companions, or any form of trained support

• You will NOT use the App as your primary or only resource for managing any mental health condition or crisis

• You will NOT rely on the App for emotional support, mental health treatment, crisis intervention, or substitute human relationships

• You will contact appropriate professional services, crisis hotlines, or emergency responders if you experience any form of mental health crisis

• You confirm that you are not currently in active mental health crisis at the time of creating your account

If you are unsure whether your current state warrants professional consultation, please contact 988 or a licensed mental health professional before continuing to use the App.
6. Subscription and Billing
Access to certain features of Fed-Up requires an active subscription. The App also offers a free trial tier with limited access.
By subscribing, you agree to:

• Pay applicable subscription fees in accordance with the pricing displayed at the time of subscription

• Allow automatic renewal of your subscription unless canceled before the renewal date

• Manage billing through the platform provider (Apple App Store or Google Play)

6.1 Automatic Renewal Disclosure
Subscriptions renew automatically at the then-current rate unless you cancel at least 24 hours before the renewal date. By subscribing, you specifically authorize automatic renewal at the rate displayed at the time of subscription, subject to any rate changes communicated in advance.
6.2 Cancellation
You may cancel your subscription at any time through your platform account settings (Apple App Store or Google Play). Cancellation takes effect at the end of the current billing period. Cancellation requires no more steps than the subscription process required. No telephone call, customer service interaction, or written request is required to cancel.
6.3 Rate Changes
If we change the subscription rate, we will provide notice at least 30 days before the new rate takes effect. You may cancel before the new rate becomes effective without penalty.
6.4 Refunds
We do not process refunds directly. Refunds are governed by the policies of the applicable app marketplace (Apple App Store or Google Play). Subscriptions terminated for violation of these Terms are non-refundable.
6.5 Free Trial
If we offer a free trial, the trial period and conditions will be clearly disclosed at the time you accept the trial. Unless you cancel during the trial period, your subscription will automatically convert to a paid subscription at the end of the trial.
7. Intellectual Property
All elements of the App, including:

• Design and interface

• Branding and logos

• Visual assets

• Software and codebase

• AI persona designs, personality bibles, and system frameworks

• Documentation and marketing materials

are the property of Fed-Up Holdings LLC or its licensors and are protected by applicable intellectual property laws of the United States and other jurisdictions.
You may not copy, modify, distribute, sell, lease, license, reverse engineer, or create derivative works of any portion of the App without prior written consent from Fed-Up Holdings LLC.
7.1 Your Content License to Us
You retain ownership of content you upload (“User Content”). By submitting User Content, you grant Fed-Up Holdings LLC a limited, non-exclusive, worldwide, royalty-free license to process, store, transmit, and use your User Content solely for the purpose of operating the App, generating AI responses for you, enforcing these Terms, and complying with law. This license terminates when you delete the content or your account, except as required for legal, investigatory, or backup purposes.
7.2 Your Representations Regarding User Content
You represent and warrant that you have the necessary rights to submit any User Content, including but not limited to any images, text, voice recordings, or other material. You will not submit User Content that infringes any third party’s intellectual property, privacy, publicity, or other right.
You acknowledge that User Content may incidentally include third-party intellectual property — such as photographs of objects bearing brand logos, ambient music captured in voice recordings, or visible printed material in uploaded images. You will not submit User Content that is primarily designed to display, distribute, or use such third-party intellectual property. You indemnify Fed-Up Holdings LLC for any claims arising from third-party intellectual property contained in your User Content.
8. DMCA Copyright Policy
Fed-Up Holdings LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content available through the App infringes a copyright you own or control, please notify our designated agent below.

A valid DMCA notification must include the information required by 17 U.S.C. § 512(c)(3). The full DMCA policy is available on our website at https://www.fed-up.app.
Repeat infringers will have their accounts terminated.
9. Reporting Violations
If you become aware of content or conduct on the App that violates these Terms — including any zero-tolerance violation under Section 3.1 — please report it immediately using the in-app reporting tools or by contacting us through the methods listed in the App and on our website at https://www.fed-up.app. We review all reports.
For emergencies involving threats of harm or illegal activity, contact local law enforcement.
